The Terms and Conditions (“Terms”) describe how DOCK LIMITED T/A DOCK PHARMACY  128 DOCK ROAD, TILBURY, ESSEX RM18 7BJ (“Company,” “we,” and “our”) regulates your use of this website WWW.DOCKPHARMACY.COM (the “Site”). Please read the following information carefully to understand our practices regarding your use of the Site. The Company may change the Terms at any time. The Company may inform you of the changes to the Terms using the available means of communication. The Company recommends you to check the Site frequently to see the actual version of the Terms and their previous versions.

 

If you represent a legal entity, you certify that you entitled by such a legal entity to conclude the Terms as the legal entity you represent.

Third-party rights

Nothing in these Terms and Conditions is intended to nor shall it confer a benefit on any third party under the Contracts (Rights of Third Parties) Act 1999 and a person who is not a party to these Terms and Conditions has no rights to enforce them.

Waiver

No delay or decision not to enforce rights under these Terms and Conditions will constitute a waiver of the right to do so and will not affect rights in relation to any subsequent breach.

Governing law

These Terms and Conditions are subject to the laws of England and Wales and each of us hereby submits to the non-exclusive jurisdiction of the English and Welsh courts.

We reserve the right to change these terms and conditions at any time. The new version will be posted on this website and will take effect immediately upon posting.

If you use the website after the new terms and conditions have come into effect, you will be indicating your agreement to be bound by the new terms and conditions.

Online Pharmacy (prescription-only medicine ordering)

The following terms apply to your use of the DockPharmacy prescription ordering service. These are additional to and supplement our general website terms and conditions which also apply.

Prescriptions for persons other than yourself

If the prescription is for a person other than yourself, you will need to have the authority of the person whose prescription it is to have it dispensed by us. By placing an order to dispense another person’s prescription you confirm that you have the authority to do so.

Age restrictions

We only accept Prescription Orders from customers who are 18 years old or over although they may order prescriptions for persons who are under 18. By placing an order, you confirm that you are at least 18.

Binding agreement

No Prescription Order placed by you will be binding on us until we have confirmed the order to you by email or in writing. We reserve the right to reject any order

Verification of prescription

When we receive a prescription from you we will verify it against the information provided to us at the time the order was placed. In the event that the information does not match with your original order, we may try to contact you using the information in your registration. If we cannot contact you and we are unable to dispense the item(s) on your Prescription Order we reserve the right to return your prescription to you.

Non-receipt of prescription

If you place a prescription order and we do not receive the relevant prescription, we will not have any liability to you and it will be your responsibility to contact us within 30 days regarding your prescription order. There is an administration fee for ordering without a prescription.

Non-availability/suitability of products

If any of the items on your prescription are not available or are not suitable for dispensing through this service, we will try to contact using the information in your registration and refer you to a local Pharmacy.

Notification of errors

You should check the items dispensed to you carefully and promptly upon receipt. If you believe there may have been a dispensing error, you should contact us immediately and should not take or use any of the items.

Warning

You must check all items dispensed to you and should not take any medication that appears to have been tampered with or which may have been dispensed in error.

Failure to abide by this warning could seriously damage your health.

Registration

In order to use this service, you will need to register on this website.

Age restrictions

We only accept orders from persons aged 18 or over. By placing an order, you are confirming that you are in this age range.

Placing an order

It is your responsibility to check that your order is accurate before submitting it to us.

Concluding a binding contract

When we receive an order from you to purchase items from us, we will confirm that we have received the order by email to the address provided by you in your order. Your order is an offer to purchase an item and will not be binding on us until you have received an email to confirm that we have dispatched that item to you or you receive the item.

Our professional codes of conduct and legal restrictions may limit the number of any item we are permitted to supply to you and, as such, we have no obligation to supply quantities exceeding the relevant permitted maximum and will charge only for those we do supply. We reserve the right to reject any order.

At Dock Pharmacy, patient safety and patient education is our top priority. As such we have written the policy below to protect customers from harm and also to ensure the customer is informed about their self-care using OTC products. We also want to ensure customers know when to go to another healthcare professional for investigations around their symptoms.

Our pharmacy medicines sold online, the order is only released if the pharmacist is satisfied that it is suitable and safe for you to take and our medicines restriction, self-care and signposting policy is applied.

To ensure, best safe practice for misused medicines
To ensure patients do not have more medication than they need
Ensuring patients are alerted when they should be signposted to a more appropriate service e.g. their GP or a specialist.
To alert our healthcare team if a customer has a recurring problem which may indicate an underlying health issue.

Which Medicines should not be purchased together?
Usually, medicines that have similar effects on the body cannot be purchased together via our software. E.g. “ Codeine containing products, or two Promethazine containing products. If you have purchased one of these products we limit further purchases within a 28 day (or varying days depending on dosage) time-frame.

The software either will alert our pharmacist at the time of sale or during our pharmacist check.

We also have varying ingredients that cannot be purchased together that are for different ailments as the risks associated with the two being taken together outweigh the benefits of treating both conditions simultaneously.

E.g. Codeine and Promethazine (Or other antihistamines) containing products cannot be purchased together as their cumulative sedative effects can be dangerous.

Repeat Purchasing

Our software will flag up repeat purchases of a particular ingredient. Despite the fact you may be restricted for 28 to 60 days if you order a product regularly each month, for example, loperamide for IBS or Chron’s disease this will flag to our healthcare team and we will request to confirm your diagnosis with your own GP. Quite often patients are told by their GP to come to an Online Pharmacy and purchase things such as Loperamide, Phenergan for long term conditions that are being monitored, as they are cheaper to purchase than to have via NHS prescription. When your GP comes back to us we can supply the medication once diagnosis s confirmed. You will also be flagged as being approved for Chronic treatment and reminded to speak to your GP regularly.

Signposting

If our healthcare team feel that your condition would be more suitably treated or investigated face to face they will request that you visit your own GP or another service in your area to ensure you get the correct care.
